General terms and conditions

Definitions

Flamingo Boat Tours B.V., registered in Amsterdam, Netherlands, at Fred. Roeskestraat 115, Studio 3.3, 1076 EE Amsterdam, under KvK number 98501208, is hereinafter referred to as the Supplier.

The other party to these terms is referred to as the Guest.

Agreement means the contract under which the Supplier provides services to the Guest in exchange for payment, and to which these General Terms apply.

Applicability of the Terms

These terms apply to all offers, invoices, work, agreements, and services of the Supplier unless otherwise agreed in writing.
The latest version always applies.
If any provision is invalid, the rest remains in force.
The Supplier may amend these terms unilaterally.

Offers and Bookings

The Supplier is not liable for obvious errors in offers.
Bookings for public cruises may be made on the day of departure.
Minors may participate only with an adult.
Private cruises may be booked online or by email. Once the Guest accepts an offer, the Agreement is concluded and the payment obligation arises.
The Guest receives booking confirmation after payment.

Prices and Payment

The Agreement is for a fixed duration unless agreed otherwise.
All prices include VAT unless stated otherwise.
Standard packages apply to public cruises; extras are charged separately.
Surcharges may apply for non-standard pickup/drop-off points and corkage if Guests bring their own food or drinks.
Cleaning fees may apply (minimum 1 hour).
Supplier may adjust prices annually or when necessary.
Payment is required at booking; the booking is confirmed only after full payment.

Information Provided by the Guest

Guests must provide necessary information in time.
The number of guests for private cruises must be confirmed 24 hours in advance.
Guests are responsible for accuracy of information.
Guest compensates Supplier for losses due to non-compliance.

Changes and Cancellation

Supplier may try to reschedule if cancellation is due to unforeseen circumstances.

Cancellation of Private Cruises

• More than 4 weeks: 10%
• 4–2 weeks: 25%
• 2–1 week: 50%
• 7–2 days: 75%
• Less than 48 hours: 100%
  
  

Changing the Date of a Private Cruise

• More than 2 weeks: free
• 2 weeks–48 hours: €100
• Less than 48 hours: €150 + €50 per captain-hour
  
  

Public / Small Group Cruises

• Refund possible up to 48 hours before departure.
• Within 48 hours: 1 ticket can be rescheduled once; others must be repurchased.
  
  

Trip Cancellation Protection

Allows cancellation up to 4 hours before departure. Contact: flamingoshelp@gmail.com

Transfer of Booking

Allowed if Supplier is notified at least 48 hours in advance.

Weather Conditions

• Dangerous weather cancels the cruise. If rescheduling is impossible, a full refund applies. Rain/cold are not grounds for cancellation.
• Supplier may cancel a public cruise with fewer than 3 guests (at least 4 hours prior).
• Gift cards are non-refundable and valid for 18 months.

Liability

Supplier not liable except in cases of intent or gross negligence.
Supplier not liable for damage caused by incorrect information from Guest.
Supplier not liable if Guest ignores instructions.
Supplier not responsible for theft or loss of personal items.
Supplier not liable for force majeure preventing cruising.
Guest must reimburse damage caused to Supplier’s property.
Liability is limited to insurance coverage or invoice amount.
Guest indemnifies Supplier against third-party claims.

Complaints

Complaints must be submitted within 48 hours.
Late complaints void the right to correction or compensation.
Complaints do not suspend payment obligations.

Intellectual Property

Supplier retains all IP rights to information, routes, data, etc.
This information may not be copied, shared, or resold without written permission.

Dispute Resolution

Dutch law applies.
Parties must first attempt amicable resolution.
Disputes handled exclusively by court where Supplier is registered.
Limitation period for all claims is 12 months.
